1. Scope

These terms and conditions apply to all contracts via the online shop of SUN GARDEN POLSKA Sp. z.o.o. sp. k. (hereafter "SUN GARDEN").

2. Conclusion of contract

Your order represents an offer to SUN GARDEN to conclude a purchase contract. After placing the order, we will send you an e-mail confirming the receipt of your order and listing the content of your order (order confirmation). This order confirmation does not constitute acceptance of your offer to conclude a contract. A purchase contract with SUN GARDEN will only be concluded when we ship the ordered goods to you or confirm the shipment to you with a second e-mail (shipping confirmation).

3. Right of withdrawal

You can cancel your contract within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the case before the deadline - by returning the goods. The period begins on receipt of this instruction in writing, but not before receipt of the goods at the recipient and not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB.

To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.

consequences of Withdrawal

In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered. If you can not give back or give us the received performance as well as uses (eg benefits of use) or not or only in a deteriorated condition, you have to pay us compensation. For a deterioration caused by intended use of the thing, you do not have to pay any compensation. You only have to pay compensation for drawn benefits if you have used the goods in a way that goes beyond checking the properties and functionality. "Testing the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a retail store.

Transportable items are to be returned at our risk. You have to bear the regular costs of the return, if the delivered commodity corresponds to the ordered and if the price of the thing to be returned does not exceed an amount of 40 euro or if you with a higher price of the thing at the time of the revocation still not the consideration or a contractually agreed partial payment. Otherwise, the return is free for you. Non-parcels are picked up at your place.

Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.

4. Invoice

The invoice will be sent to you electronically by e-mail as a PDF file.

5. Prices

All prices include applicable VAT. As a rule, Polish VAT (VAT).

6. Payment

The purchase price can only be paid in advance by bank transfer. Payment must be made within two weeks of the invoice date.

7. Delivery

The delivery will be made to the delivery address given by the customer against payment of the shipping costs, which are stated for each order.

SUN GARDEN always strives to send ordered items as quickly as possible. Nevertheless, no binding or guaranteed information can be made about shipping or delivery dates. Information on the availability of individual products contained in the online shop does not constitute such promises. In general, the shipping takes place within the time specified in the order process. If there is a delay, you can contact the above e-mail or fax number, or we will contact the buyer and inform him.

8. Warranty

The guarantee takes place according to the legal regulations (§ 434 ff. BGB). SUN GARDEN reserves the right to provide supplementary performance at its discretion by rectifying the defect or delivering a faultless item.

If the supplementary performance is carried out by way of delivery of a defect-free item, the customer is obliged to return the initially delivered, defective goods to SUN GARDEN within 30 days at the expense of SUN GARDEN, if requested by SUN GARDEN.

9. Applicable law

German law applies excluding the UN sales law (CISG).

10. Set off

Offsetting claims against SUN GARDEN is only permitted with undisputed or legally established counterclaims.
